Terms and Conditions

General

  • By booking any accommodation, catering, activities or services at Five Acres you agree to these Terms and Conditions (T&C). In the event that you book through a third party platform such as Airbnb.com, the terms and conditions of that platform also apply to your booking; however, Five Acres’ T&C rank in priority.
  • These T&C apply to the person booking the accommodation/goods/services with Five Acres (Reservation Holder), along with any children, guests, or other persons present (Guests) on the Five Acres property associated with the Reservation Holder.
  • The Reservation Holder is responsible and liable to Five Acres for any financial matters, such as damage to property, and also for the behaviour and conduct of any Guests present at Five Acres.
  • Five Acres is a working farm, with live animals, machinery, native wildlife and other risks. Staying at, or attending the property is entirely at your risk and the risk of the Reservation Holder and Guests. Please be alert to your surroundings at all times. We require that all animals at Five Acres are treated with care and respect. Children must be supervised by their parents at all times.
  • The Reservation Holder and Guests must comply with the directions of our Staff in relation to all matters.
  • Should the Reservation Holder or Guests act in any way that Five Acres determines is inappropriate, dangerous or otherwise unacceptable, all of the Reservation Holder and Guests will be required to leave the property. In these circumstances, no refund or credit will be issued in respect of unused accommodation/goods/services.
  • Five Acres requires the holding of credit card details as security for damage, excess cleaning costs and extra charges incurred in relation to the Reservation Holder’s visit. A $500 pre-authorisation will be activated on the morning of arrival and will be deactivated 7 days after departure if no funds are required to be retained for cleaning or damage.
  • In the event that damage is caused to the property by the Reservation Holder or Guests, the Reservation Holder will be liable for such damage and all costs associated with such damage shall be deducted from the Reservation Holder’s credit card pre-authorisation. If the credit card pre-authorisation does not cover the damage, then those further costs shall be debited to the Reservation Holder’s credit card provided upon booking with Five Acres. The Reservation Holder agrees to the deduction of such amounts from their credit card.
  • No smoking is permitted on the Five Acres property or within the buildings/accommodation at Five Acres. Those smoking will be asked to leave the property. In the event of smoking taking place in the buildings, the Reservation Holder will be charged an additional cleaning fee of $770 to clean carpets, curtains and air conditioners, etc.
  • No caravans, tents, campers or other portable accommodations are permitted on the property.
  • Pets are not permitted on the property.
  • The Reservation Holder and Guests must be considerate with noise levels and must reduce noise after 10.00pm.
  • The Reservation Holder and Guests acknowledge that there are risks associated with attending the property and they each agree that attending the property is at the risk of each person attending the property. Reservation Holder, Guests, guardians, personal representatives and any other heirs, irrevocably agree to release, waive, discharge, hold harmless, defend, and indemnify Five Acres and all its Staff from any and all claims, actions or losses as a result of bodily injury, property damage, wrongful death, loss of services or otherwise which may arise out of participation in all activities while at the property.

Accommodation

  • Check in is at 2.00pm on the date of booking. Checkout is strictly 10.00am on the day of departure. Late check out will incur additional fees equal to one day’s accommodation which will be charged to the Reservation Holder’s credit card.
  • The property is let to the Reservation Holder and Guests for the period stated in the booking confirmation. Reservation Holder and Guests agree to not sublet or assign the property or any part of it. The booking is non-transferable. Extensions of stay are subject to availability and approval by Five Acres.
  • Payment of all accommodation fees is required at the time of booking in order to secure the accommodation booking.
  • Accommodation fees can be paid by credit card through our website or directly with Five Acres. A 2% service fee applies to credit card payments.
  • All amounts are expressed and processed in Australian dollars, inclusive of GST.
  • Children are welcome in the guest house at Five Acres, provided that all accommodation at Five Acres has been booked by the same family group for the duration of the stay. The cabins are bespoke accommodation for couples only. You must ensure that children do not enter the cabins at any time.
  • Five Acres has the right to enter and inspect any accommodation and buildings during the Reservation Holder and Guests stay, subject to reasonable prior notice being given, unless Five Acres has reasonable grounds to believe that the buildings are being damaged, at risk, or if there are any breaches of these T&C.
  • The accommodation is strictly for the number of persons/children as booked. Additional guests will be charged accordingly. The maximum occupancy of the accommodation must not be exceeded.
  • The accommodation is let to the Reservation Holder or Guests for holiday letting purposes only, for the period stated in our letter of confirmation. No commercial activities of any kind are permitted, unless prior arrangements have been made. Such permission is at the sole discretion of Five Acres and if approved, a surcharge will apply.
  • Children are welcome at the property; parents are solely responsible for the supervision, care and actions of their children whilst at Five Acres. Five Acres accepts no liability for the actions of children whilst on the property.
  • Car parking is available in front of the workshop and 2 spaces in front of the Reservation Holder’s accommodation.
  • We expect and encourage an appropriate level of care to be used during stays. On departure, the accommodation must be left in a similar state to its condition on arrival. Please remove any residual food from the fridge and pantry that you supplied during the stay. Any extra cleaning required will result in a $75 per person-hour additional charge – minimum charge is $150.

Cancellation Policy

  • Five Acres cancellation policy requires any cancellation/rebooking/rescheduling requests to be made in writing.
  • Any money paid for accommodation which is put into credit due to cancellation will sit on the Reservation Holder’s account and last 2 years from the cancellation date. If the credit is not used towards another booking within 2 years, the credit will be forfeited.
  • The following notice periods apply to cancellation of Five Acres accommodation:

More than 30 days’ written notice

Any money paid will be put into credit for use towards a future booking based on availability.

Under 30 days’ written notice

80% of money paid will be forfeited. The remaining 20% will be put into credit for use towards a future booking based on availability.

Under 7 days’ written notice

100% of money paid will be forfeited.

Any time due to government restrictions which apply to Five Acres or Reservation Holder, preventing the Reservation Holder from lawfully attending the property

Any money paid will be put into credit for use towards a future booking based on availability. This credit will sit on the Reservation Holder’s account and last 2 years from the cancellation date. If the credit is not used towards another booking within 2 years all money paid will be forfeited.

Sauna Terms

These Sauna Use Terms & Conditions (Sauna Terms) apply to all persons who access or use the Sauna facilities operated by Five Acres.

By entering or using the Sauna, you acknowledge and agree to these Sauna Terms.

Definitions

  • Sauna means Five Acres’ sauna and any associated areas, fixtures and equipment (including benches, heating elements, doors, temperature controls, timers, showers and entry/exit areas).
  • Staff means Five Acre’s employees, contractors and agents.
  • Injury includes any injury, illness, medical event, aggravation of a pre-existing condition, or death.
  • Loss includes loss, damage, costs, expense or liability (including legal costs on a full indemnity basis, where applicable).

Eligibility, Access and Hours

  • Use of the Sauna is permitted only for:
    • registered guests of Five Acres; and/or
    • any other persons expressly authorised by the Five Acres,
      who have signed these Sauna Terms in advance of using the Sauna.
  • Sauna users must be at least 16 years of age. Persons under 16 years are strictly prohibited from using the Sauna, regardless of parental consent.
  • Operating hours, capacity limits, and booking requirements (if any) are as displayed at the Sauna and/or advised by Staff.
  • Five Acres may refuse entry, suspend access, or require you to leave the Sauna area for safety, hygiene, operational, or compliance reasons.

Health, Medical Conditions and Fitness to Use

  • You must only use the Sauna if you are medically and physically fit to do so.
  • You must not use the Sauna if you:
    • are under the influence of alcohol, illicit drugs, or medications that may impair judgment, balance, thermoregulation or consciousness;
    • feel unwell, dizzy, faint, dehydrated, or have symptoms of heat stress;
    • have a condition that may increase risk, including but not limited to cardiovascular disease, uncontrolled high/low blood pressure, respiratory conditions, epilepsy, heat intolerance, or other conditions affected by heat exposure; or
    • have open wounds, contagious illness, or any condition that creates a hygiene or health risk for others.
  • Pregnant users should not use the Sauna unless they have assessed the risks and are confident it is safe for them and, where appropriate, have obtained medical clearance.
  • You must exit the Sauna immediately if you experience discomfort, dizziness, nausea, chest pain, palpitations, shortness of breath, or other concerning symptoms.

Safety Rules

You must comply with all signage and instructions given by Five Acres and its Staff. Without limitation, you must:

  • follow posted temperature/time guidelines and take regular cooling breaks;
  • keep hydrated before and after use of the Sauna;
  • use the Sauna in a safe manner (no running, horseplay or unsafe conduct).
  • always sit/lie on a towel at all times (hygiene requirement) and keep the area clean and dry;
  • wear appropriate attire as specified by Five Acres policy/signage;
  • not pour water, oils, or other substances on heating elements;
  • not touch heating elements, sensors, vents, or electrical controls except as permitted;
  • not bring glass, sharp objects, or hazardous items into the Sauna;
  • not bring valuables into the Sauna;
  • not use the Sauna alone if you are at increased risk, including where you have a medical condition, are inexperienced, or feel unwell;
  • keep Sauna doors unobstructed and do not tamper with locks, emergency mechanisms, or safety devices; and
  • comply with Sauna capacity limits.

Electrical Devices

The use of electrical devices in the Sauna is strictly prohibited. This includes:

  • Mobile telephones;
  • Laptops;
  • Tablets, including iPads;
  • Earphones/Headphones;
  • Music devices, such as iPods;
  • Massage devices; and
  • Smartwatches.

Supervision and Duty to Follow Instructions

  • The Sauna is not supervised. You use the Sauna entirely at your own risk.
  • You must immediately comply with any reasonable direction from Staff relating to safety, hygiene, operations, guest amenity, or compliance with these Sauna Terms.
  • Five Acres and/or its Staff may remove you from the Sauna area and terminate your accommodation if you:
    • breach these Sauna Terms;
    • act in a way that endangers yourself or others; or
    • cause damage or unreasonable disturbance.

Assumption of Risk

  • You acknowledge that Sauna use involves inherent risks, including, without limitation, overheating, dehydration, fainting, slips/falls, burns, aggravation of existing medical conditions, and other injury.
  • You voluntarily assume all inherent risks associated with using the Sauna,
    • including risks arising from:
    • elevated heat and humidity;
    • surfaces that may be hot;
    • wet or slippery floors; and
    • the conduct of other Sauna users.

Liability – Australian Consumer Law and Victorian Law

  • Nothing in these Sauna Terms excludes, restricts or modifies any non-excludable right, guarantee or remedy you may have under the Australian Consumer Law or other applicable laws.
  • To the maximum extent permitted by law, Five Acres and its Staff are not liable for any loss or injury you suffer in connection with your use of the Sauna, except where that loss or injury is caused by Five Acre’s (or its Staff) negligence, breach of statutory duty, or other conduct that cannot legally be excluded.

Release and Indemnity

  • To the maximum extent permitted by law, you release Five Acres, its Staff, agents and contractors from and against all claims, demands, actions or proceedings arising from or connected with your use of the Sauna, including any claim for injury or loss, except to the extent caused by Five Acres’ negligence or other conduct that cannot be excluded by law.
  • You fully indemnify Five Acres, its Staff, agents and contractors against any claim or loss suffered by them arising from or connected with:
    • your breach of these Sauna Terms;
    • your negligent, reckless, or wilful acts or omissions;
    • your failure to follow signage or Five Acres’ or Staff directions; or
    • any claim brought by a third party arising from your conduct in the Sauna area, except to the extent that Five Acres or its Staff caused or contributed to that Loss.

Damage and Cleaning Costs

  • You are responsible for any damage you cause to the Sauna or surrounding facilities and accommodation, including through misuse, tampering, or introducing prohibited substances and indemnify Five Acres for any loss and damage.
  • Five Acres may charge you for reasonable repair, replacement, and/or additional cleaning costs resulting from your breach of these Sauna Terms, to the extent permitted by law and consistent with Five Acres’ General Terms and Conditions.

Refusal of Service and Termination of Access

  • Five Acres may suspend or cancel your access to the Sauna immediately if, in their reasonable opinion, you:
    • pose a safety risk;
    • are intoxicated or impaired;
    • fail to follow Five Acres’ Staff directions; or
    • breach these Sauna Terms.
  • Suspension or termination of Sauna access does not affect any other rights Five Acres has under its General Terms and Conditions, your accommodation agreement, or at law. You agree that suspension or termination of Sauna access is not a valid ground for you to terminate your accommodation with Five Acres. Should you do so, Five Acres is not required to reimburse you or refund you for any unused accommodation costs.

Emergency

  • In an emergency, follow emergency signage and Staff directions.
  • If you observe an unsafe condition, notify Staff immediately.
  • If you feel unwell, exit the Sauna immediately and seek assistance from Staff.

General

  • Five Acres may update these Sauna Terms from time to time. The version displayed at the Sauna (and/or provided at reception) applies at the time of use.
  • If a provision of these Sauna Terms is unlawful or unenforceable, it is severed and the remaining provisions continue in force.
  • These Sauna Terms are governed by the laws of Victoria, Australia.
  • If there is any inconsistency between these Sauna Terms and any mandatory legal requirement, the mandatory legal requirement prevails.

Acknowledgement and Acceptance

By entering and using the Sauna, you confirm that you:

  • have read and understood these Sauna Terms;
  • agree to comply with all signage and Staff instructions;
  • accept the inherent risks of Sauna use; and
  • understand that certain rights and remedies cannot be excluded under Australian law.
